Two judges ruled today to block "voting challengers" at voting locations. Secretary of State Ken Blackwell supported this saying bipartisan poll workers can do the job without interference from outside groups.

However, I just watched a bit of "Hannity & Colmes", something I rarely do and they mentioned that the above decisions had been overturned by a higher court. I can't find anything online to confirm this, but if H & C is accurate, it looks like the 6th circuit overturned the earlier ruling. Can anyone else confirm this?

I don't think we need to get all gung ho about challenging the challengers for two reasons.

    1. How is the GOP going to field all of these people with zero notice?

    2. If you're not in an African-American community, you probably won't be affected. Whew, isn't that a relief?

Wow, Hannity and Colmes have good information. According to the Akron newspaper, this ruling came THIS MORNING.

It would suck to live in a district with a lot of minority voters. Judge Dlott is correct:
....creates an extraordinarily and potentially disastrous risk of intimidation and delay.... This court finds that the presence of vast numbers of challengers inexperienced in the electoral process, under these conditions, imposes a severe burden on the right to vote of individual voters and of Ohio voters at large
<font size="2" face="Verdana, Helvetica, sans-serif">Here's a couple of interesting things. The article mentions that it was a three-judge panel of the 6th U.S. Circuit Court of Appeals in Cincinnati, but it does not give the names of the judges. Also, why is it that usually the court is grindingly slow, but in these specific challenges etc., we not only get extremely swiftly moving judges, but they CONVENE IN THE EARLY HOURS OF THE MORNING! I call shenanigans, they are making law from the bench.

I think I spotted one (see the I voted thread) but then again I am one of those privileged with the skin color that apparently doesn't get challenged at the polls.

<font size="2" face="Verdana, Helvetica, sans-serif">No they aren't. They are interpreting existing state law. They found the challenger law constitutional.
